D1. Legal Obligation
Under the Liquor Control Reform Act 1998 (Vic) and Licence No. 32812217, Tanoshi Michi Pty Ltd (trading as Tano Spirits) is legally required to ensure that alcohol is not supplied to persons under the age of 18 years. This Age Verification Policy sets out how we meet this obligation in the context of online sales.
D2. Declaration at Point of Purchase
Before completing any purchase of alcohol on this Website, you must affirm that you are 18 years of age or older by checking an age declaration at checkout. This declaration forms part of your contract with us and creates a legal obligation. Providing a false declaration is an offence under Victorian law.
D3. Age Verification at Delivery
Age verification is not completed solely at the point of online purchase. Our delivery partners and/or our own delivery staff are required to verify the age of the recipient at the point of delivery. The following applies:
- The person accepting delivery must be 18 years of age or older
- Proof of age (e.g., driver's licence, passport, Victorian Proof of Age Card) may be requested at the door
- If the delivery driver has reasonable grounds to believe the recipient is under 18, delivery will be refused
- If no person aged 18 or over is available to accept delivery, the order will not be left unattended
- Failed deliveries due to age verification failure will be returned and a refund issued minus delivery costs
D4. Acceptable Proof of Age
For the purposes of delivery, acceptable proof of age includes:
- Australian driver's licence or learner's permit
- Victorian Proof of Age Card (POA card)
- Current Australian or foreign passport
- National Identity Card (foreign government-issued)
- Any other document prescribed under the Liquor Control Reform Act 1998 (Vic)
D5. Electronic Age Verification
In addition to declaration-based verification, we may use third-party electronic age verification services to authenticate purchaser identity and age. This may involve the matching of your name and date of birth against third-party databases. Any information used for electronic verification is handled in accordance with our Privacy Policy (Part C) and the relevant provider's privacy policy.
D6. Gifts and Third-Party Recipients
If you are purchasing alcohol as a gift for a third party, you are responsible for ensuring that the intended recipient is 18 years of age or older. We will apply the same age verification requirements at delivery regardless of whether the recipient is the purchaser. If delivery is to a third-party address, we strongly advise you to confirm the recipient's age before ordering.
D7. Refusal of Sale
We reserve the right to refuse or cancel any sale where we have reasonable grounds to believe that the purchaser or recipient is under 18 years of age, or where we are unable to verify age to our satisfaction. In such cases, a full refund will be provided.
